Law for the prevention of money laundering and terrorist financing

The following also applies to HAP Horecamakelaardij: the broker is designated as a gatekeeper

You may have noticed that we have recently been asking several questions.
This is because since July 25, 2018, the government has given brokers (previously it was mainly the banks) the role of gatekeeper. This entails the necessary changes and responsibilities for you and us.

WHY DO WE ASK YOU VARIOUS QUESTIONS?

On the basis of the Money Laundering and Terrorist Financing Prevention Act (Wwft), we must identify our clients and verify that identity, including yours.
In short: we must determine with whom we do business.

In addition to identifying and verifying, we map out where you live.
This is due to the fact that there are countries with an increased risk of money laundering and/or terrorist financing.
That is why we investigate where you live and record this in our files.
All information is of course treated very confidentially, that goes without saying.

WHY DO WE ASK YOU ABOUT THE ORIGIN OF FUNDS?

We are not there yet, because how will you, as a buyer, finance the purchase?
In other words, where does the money come from?
Such a question may lead to misunderstanding, but unfortunately we are obliged to find out the origin of the money with which you are going to finance the purchase.
Why? Because we have to determine from the legislator that you do not want to launder money with your purchase!

If we have mapped this out, we comply with our obligation under the Wwft to conduct a customer due diligence before we are allowed to carry out a purchase or sale.
That is why it is so important that all these relevant matters are properly recorded by our office.

WET MOT (Notification of unusual transactions)

We are also obliged to report to the FIU (Financial Intelligence Unit) Netherlands if we suspect an (intended) unusual transaction.
For example, if we do not receive a plausible explanation from you about the origin of the funds.

PRIVACY GUARANTEED

We understand that every client due diligence requires privacy-sensitive information.
However, this is well established by law and regulations and brokers must comply with this. We therefore treat the data that we need to record from you very confidentially.

The request for this information does not violate the General Data Protection Regulation (GDPR).
